The Website Guy, operated by Chris Astley, provides professional web development services including but not limited to:

  • Website optimisation and performance tuning
  • Technical consulting and support

Use of Website

Permitted Use

You may use our website for lawful purposes only. You agree not to use our website:

  • In any way that violates any applicable national or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • To impersonate or attempt to impersonate The Website Guy, an employee, another user, or any other person or entity
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website
  • To use any robot, spider, or other automatic device to monitor or copy our website

User Accounts

If you create an account on our website, you are responsible for maintaining the security of your account and password. You are fully responsible for all activities that occur under your account.

Service Terms and Project Scope

Project Proposals and Quotes

All project proposals and quotes are valid for 30 days from the date of issue unless otherwise stated. Prices quoted are based on the specifications provided at the time of quotation. Any changes to project scope may result in revised pricing and timelines.

Project Timelines

Project timelines are estimates based on the information available at the time of quotation. While we make every effort to meet agreed deadlines, timelines may be affected by factors including but not limited to:

  • Delays in client feedback or approval
  • Changes to project scope
  • Third-party service dependencies
  • Unforeseen technical challenges

Client Responsibilities

Clients agree to:

  • Provide timely feedback and approvals
  • Supply all necessary content, assets, and access credentials
  • Ensure content provided does not infringe on third-party rights
  • Make timely payments as per agreed payment terms
  • Maintain regular communication throughout the project

Payment Terms

Pricing and Invoicing

All prices are quoted in GBP (£) unless otherwise stated. Payment terms will be specified in individual project agreements and typically include:

  • An initial deposit (usually 50%) before work commences
  • Final payment upon project completion or before delivery
  • Monthly retainer fees for ongoing support (if applicable)

Late Payments

Invoices are due within the timeframe specified on the invoice. Late payments may result in:

  • Suspension of work on active projects
  • Withholding of project deliverables
  • Interest charges on overdue amounts
  • Referral to debt collection agencies

Refunds

Due to the nature of digital services and custom development work:

  • Deposits are non-refundable once work has commenced
  • Refunds may be considered on a case-by-case basis for work not yet performed
  • No refunds will be issued for completed work or delivered services

Intellectual Property Rights

Client Content

Clients retain all rights to content they provide (text, images, logos, etc.). By providing content, clients grant us a license to use, reproduce, and modify the content solely for the purpose of delivering the requested services.

Developed Work

Upon full payment, clients receive ownership of custom code and designs created specifically for their project. This excludes:

  • Third-party code, plugins, or themes
  • Our proprietary tools, frameworks, or libraries
  • Code or components we've developed for other clients

Portfolio Rights

Unless otherwise agreed in writing, we reserve the right to:

  • Display completed projects in our portfolio
  • Use project screenshots for marketing purposes
  • Reference clients as case studies (with anonymization if requested)

Warranties and Disclaimers

Service Warranty

We warrant that services will be performed with reasonable skill and care. We do not warrant that:

  • Our services will meet all of your requirements
  • Our services will be uninterrupted, timely, secure, or error-free
  • Results obtained from use of our services will be accurate or reliable

Third-Party Services

We are not responsible for the functionality, reliability, or performance of third-party services, plugins, themes, or platforms (e.g., Magento, WordPress, Shopify, hosting providers).

Website Disclaimer

The information on this website is provided "as is" without warranties of any kind. We do not warrant the accuracy, completeness, or usefulness of this information.

Limitation of Liability

To the maximum extent permitted by law, The Website Guy shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages

Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless The Website Guy from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you provide that infringes on third-party rights
  • Your use of our services in violation of applicable laws

Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the business relationship. This obligation continues after the termination of the service agreement.

Termination

Termination by Client

Clients may terminate services at any time by providing written notice. In the event of termination:

  • Client is responsible for payment of all work completed up to the termination date
  • Deposits are non-refundable
  • We will provide completed work upon receipt of final payment

Termination by Us

We reserve the right to terminate services if:

  • Payment terms are not met
  • Client breaches these Terms
  • Client engages in abusive or threatening behavior
  • Project scope becomes unreasonable or unfeasible

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our website and services after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with any project-specific agreements or proposals, constitute the entire agreement between you and The Website Guy regarding the use of our website and services.
